Apple Wins Preliminary Injunction Against Samsung Galaxy Tab Sales in U.S.

reuters , allthingsd report u.s. district judge lucy koh granted preliminary injunction against sales of samsung galaxy tab in u.s.

ruling latest in ongoing legal battle between apple , samsung. apple had accused samsung of copying design of apple's ipad , iphone products. apple has sought , won injunctions against sale of same samsung tablet in other countries.

reported allthingsd, new ruling stated:

"although samsung has right compete, not have right compete unfairly, flooding market infringing products," koh wrote in order, adding strength of apple's case on merits left no choice grant injunction. "while samsung suffer lost sales issuance of injunction, hardship apple of having directly compete samsung's infringing products outweighs samsung's harm in light of previous findings court."

samsung appeal preliminary injunction order go effect once apple posts $2.6 million bond cover damages samsung if injunction not hold in appeal.

allthingsd received statement apple reiterated previous claims samsung had copied ipad:

"it's no coincidence samsung's latest products lot iphone , ipad, shape of hardware user interface , packaging. kind of blatant copying wrong and, we've said many times before, need protect apple's intellectual property when companies steal our ideas."
